Privacy statement The Health Challenge

Privacy-sensitive data or personal data is being processed via the app The Health Challenge. The Health Challenge considers careful handling of personal data of great importance. Personal data is therefore carefully processed and secured by us. We process your data on the legal basis of consent.

In our processing, we keep to the requirements of privacy legislation. This means, among other things, that:

  • we clearly state the purposes for which we process personal data. We do this through this privacy statement;
  • we limit our collection of personal data to only the personal data that is necessary for legitimate purposes;
  • we first ask you for explicit permission to process your personal data in cases where your permission is required;
  • we take appropriate security measures to protect your personal data and also demand this from organizations that process personal data on our behalf;
  • we respect your right to correct or delete your personal data at your request.

The Health Challenge is responsible for data processing. In this privacy statement, we explain which personal data we collect and use and for what purpose. We recommend that you read this carefully.

Use of personal data
When using our app, we obtain certain information from you. This can be personal data. We only store and use the personal data provided by you directly, in the context of the service you have requested, or of which it is clear that they are provided to us for processing.

We use the following information for the purposes stated in this privacy statement:

  • Name and address details
    • Name: register in the app (can be a nickname)
    • Name: sending of purchases in the web shop and / or sending the won prizes
    • Address and City: Send the purchase of web shop and / or won prizes
  • Phone number (contact about order in the web shop)
  • Business email address (register and log in to the app)
  • Email address password reset (to reset your password)
  • Your (profile) picture (not mandatory to add)
  • Location data (see section 1.4)
  • Visual material (see section 1.5)
  • Medical data (see section 1.7), only if you actively share it with us via the chat function. No further medical data is collected or processed in this app. We urge you not to share medical information with us.
  • Health data ( see section 1.8)

 

1.1 Register

For certain access to our app you have to register first. After registration, we save your username that you have chosen and the personal data you provided. We keep this information so you do not have to enter it this every time you want to log in the app. Also, we keep this information so that we can contact you in the context of the execution of the agreement.

 

We will not provide the data linked to your username to third parties, unless this is necessary in the context of the execution of the agreement that you conclude with us or if this is required by law. In case of suspicion of fraud or abuse of our app, we can hand over personal data to the competent authorities.

1.2 Access portal

With our portal, you can gain access to a management environment where you can set, specify and change things yourself.

 

1.3 Contact form

The data from the contact form will only be used to contact you about requested information.

 

1.4 Location data

If necessary for the service, we may collect location data (GPS) from you. 1) to calculate and display distances traveled and scores obtained in the app. 2) To earn points with check-ins at specific locations. This consent can be withdrawn at any time. Withdrawing permission affects the use of the app. The backend administrators cannot see where you are or when you are using the GPS.

 

This (location) data can also be stored and processed by the provider of, for example, the navigation/maps software, such as Google Maps, but the data can also be used by, for example, Google or Apple itself. We have no influence on this. We recommend that you read the relevant privacy statements of the relevant provider.

 

1.5 Images (photos and videos)

The app uses photos to provide evidence for the completion of an activity. Permission is requested by the app to allow using your camera and / or film roll. The images are only used as evidence and will be deleted immediately after the end of the challenge. The images are not provided to third parties, used for social media or other marketing purposes.

 

1.6 Web shop

If you place an order through our web shop, your data will be used to process a (possible) payment, to deliver goods / services to you and to contact you about your order.

 

1.7 Chat function

If you send a chat, we will process your data to answer the question. This may also include medical information if you share this information with us. We urge you not to share medical information with us.

 

1.8 Health data

We only use health data obtained through Health Connect, such as steps and cycled distance, for the core functionalities of our app. This data is not shared with third parties for purposes other than the app’s primary function and is never used for advertising or sold to information resellers. In line with Health Connect’s data minimization principle, we only collect the minimal amount of health data (steps and cycled distance) necessary for our app’s functionality.

 

1.9 App store

The app that provides the service has been downloaded from a third-party app store. We have no influence on which personal data the provider processes and for what purpose. We recommend that you read the relevant privacy statements from the relevant provider.

 

1.10 Publication

First name, surname, (or pseudonym) and total score are published in the app and on a web screen. This data can be viewed by other participants in the challenge. Furthermore, there will be no publication of the personal data provided by you.

 

1.11 Advertisements

Our app displays generic advertisements, provided this has been discussed with the client, whereby no personal data is collected.

 

1.12 Provision to third parties

There are three times when your data is provided to third parties.

  1. If this is necessary in the context of the performance of the agreement you conclude with us or if this is required by law.
  2. In case of suspicion of fraud or abuse of our app, we can hand over personal data to the competent authorities.
  3. During the challenge, your name (or pseudonym) and total score will be published in the app and on a web screen. (see section 1.10)

     

1.13 Cookies

Our website uses cookies. No cookies are placed in the app.

 

When you visit our website for the first time, a notice is displayed in which we explain why we use cookies. We regard your further use of our website as consent to this use of cookies.

 

You are free to disable cookies through your browser. Keep in mind that it is possible that our website will no longer work optimally.

 

1.14 Security

We take security measures to limit misuse of and unauthorized access to personal data. We prioritize the security of user data, including health data from Health Connect. Our security measures include SSL encryption for data in transit, hashed passwords for user authentication, firewall protection for our server, and daily data backups. These measures ensure the protection of health data against unauthorized access and data breaches.

 

1.15 Retention periods

The personal data described above will be kept for as long as necessary to participate in The Health Challenge, to process your orders, including warranty. After that, we store data for a maximum of one year for the statistical purposes described. The data will then be deleted, unless there is a legal obligation that requires longer retention (such as the seven-year fiscal retention obligation for payment data). If the challenge does not use the webshop function, data will be deleted no later than four weeks after the end of the challenge.

 

1.16 Third-party websites

This privacy statement does not apply to third-party websites that are connected to our app through links. We cannot guarantee that these third parties will handle your personal data in a reliable or secure manner. We recommend that you read the privacy statement of these websites before using these websites.

 

1.17 Changes to this privacy statement

We reserve the right to make changes to this privacy statement. It is recommended that you regularly consult this privacy statement so that you are aware of these changes.

 

1.18 Access and change your data

For questions about our privacy policy or questions about access and changes to (or deletion of) your personal data, you can contact us at any time using the information below.

Users can manage and delete their data, including health data from Health Connect, through the app’s settings.

You can also send us a request to view, change or delete this data. You can also submit a request for a data export for data that we use with your permission, or state with reasons that you want us to restrict the processing of personal data.

In order to prevent abuse, we can ask you to identify yourself adequately. When it comes to access to personal data linked to a cookie, you must send a copy of the cookie in question. You can find this in the settings of your browser. If the data is incorrect, you can request us to change the data or have it removed.

 

 

1.19 Dutch Data Protection Authority

Of course, we are happy to help you if you have complaints about the processing of your personal data. Under the privacy legislation, you also have the right to file a complaint with the Dutch Data Protection Authority against these processing of personal data.
